Cavender’s Rewards Program Overview.</strong></u> The Program is a free membership-based loyalty and rewards program offered exclusively by Cavender’s and our affiliates (“Cavender’s”, “we”, “us”, or “our”) to customers located in the United States (excluding Puerto Rico and U.S. Territories). The Program rewards participating customers (“Members”) with special, surprise benefits based on their engagement with Cavender’s, including purchases, special dates, and other activities (collectively, “Rewards”). Rewards are issued at Cavender’s discretion and may include discounts, exclusive offers, and other benefits. This Program is not a points based or cash rewards based program where customers earn rewards directly tied to purchases made with Cavender’s. These Program Rules, which include all additional policies (including our Privacy Policy, Terms of Use and other policies found on our website at cavenders.com) and any other terms and conditions referenced and incorporated herein, all of which may be amended from time-to-time, contain information about the relationship between you and us with respect to the Program and apply to you if you enroll, have previously enrolled, or have otherwise been informed that you have been enrolled in the Program.</p> <p style="margin-left:20px"><u><strong>2. Program Rules.</strong></u> By enrolling in, or otherwise participating in, the Program, you acknowledge that you have read, understood and unconditionally accept to be bound by the Program Rules. Cavender’s reserves the right to modify, delete or otherwise change any of the terms and conditions in the Program Rules in our sole and absolute discretion, without further notice or compensation to you, and you waive any right to receive specific individual notice of such modifications. This means that Cavender’s may make material changes to the Program, including but not limited to, the number of participating stores and type and/or frequency of Rewards provided in connection with the Program. This also means that Cavender’s may terminate the Program, or any benefit of the Program, or substitute the Program for similar or different loyalty and rewards program at any time. Any updates to these Program Rules will be effective immediately upon posting at cavenders.com, and your continued participation in the Program constitutes your acceptance to such modifications. These Program Rules constitute a legally binding agreement between Cavender’s and each individual who enrolls or otherwise participates in the Program. Accordingly, you expressly represent and warrant that you are eligible for the Program (as described below) and will otherwise comply with these Program Rules. If you do not agree to all of the Program Rules now or at any point in the future or you become ineligible for the Program, please contact Customer Service at (888) 361-2555 to un-enroll.</p> <p style="margin-left:20px"><u><strong>3. Eligibility. </strong></u>The Program is open to residents of the United States (excluding Puerto Rico and U.S. Territories) who: (i) have reached the age of majority in their state of residence and are at least 18 years of age; (ii) provides valid and accurate personal information when enrolling in the Program; (iii) is not already a Member (defined below) of the Program; and (iv) has not previously been terminated from the Program (collectively, the “Eligibility Requirements”).
